Terms of Service

1. Service Description

Contentpole is an AI-powered content creation platform that enables users to generate AI influencer images and videos. By accessing or using our service, you agree to be bound by these Terms of Service and our Privacy Policy, which describes how we collect, use, and protect your personal data. If you do not agree, do not use our service.

2. Account Registration

To use Contentpole, you must create an account using a valid email address or Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to use this service.

3. User Warranties

By using Contentpole, you represent and warrant that:

  • You are at least 18 years of age
  • You will not use generated content for any illegal purpose
  • You will not violate any third-party intellectual property rights
  • Generated content will not depict real minors in any context
  • You will comply with all applicable local, state, national, and international laws
  • All information you provide to us is accurate and complete

4. Credit System & Subscriptions

Contentpole operates on a credit-based system. Our subscription plans range from $19 to $89 per month, providing 200 to 2,000 credits per billing cycle. Credits are consumed when generating images and videos. Unused credits do not roll over to the next billing period unless otherwise stated in your plan.

5. Billing & Payments

Subscriptions are billed monthly. Payments are processed through Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.

6. Generated Content & Intellectual Property

You have full commercial rights to use, modify, and distribute content generated on Contentpole. However, AI-generated content may not be eligible for copyright protection under U.S. law. You are solely responsible for how you use, publish, and distribute generated content. Contentpole retains no ownership over your generated images and videos. We reserve the right to use anonymized, aggregated usage data to improve our service.

7. AI Content Disclaimer

AI-generated content may contain inaccuracies, visual artifacts, or unintended results. Contentpole does not guarantee the quality, accuracy, or suitability of generated content for any specific purpose. You acknowledge that AI outputs are inherently unpredictable and accept the results as-is.

8. Prohibited Uses & Deepfake Policy

You must comply with our Acceptable Use Policy for a complete list of prohibited activities. The following are strictly prohibited and may result in immediate account termination without refund:

  • Creating deepfakes of real individuals without their explicit consent
  • Impersonating real people for fraud or deception
  • Creating non-consensual intimate imagery
  • Using generated content to mislead, scam, or defraud others
  • Generating child sexual abuse material (CSAM) or any content depicting minors inappropriately
  • Harassment, hate speech, or content promoting violence

9. Third-Party Services

Contentpole relies on third-party services to operate, including Stripe for payment processing and Fal.ai for AI generation. Your use of these services is subject to their respective terms and privacy policies. Contentpole is not responsible for the availability, accuracy, or conduct of any third-party service.

10. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms or our Acceptable Use Policy. You may delete your account at any time by contacting support. Upon account deletion, your generated content and personal data will be permanently deleted within 30 days, except where retention is required by law or for backup purposes (backups are purged within 90 days).

11. Indemnification

You shall indemnify, defend, and hold harmless Contentpole, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of generated content
  • Your violation of these terms or any applicable law
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any content you generate, publish, or distribute using the service

12. Limitation of Liability

Contentpole is provided "as is" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim. We do not guarantee uninterrupted service availability or specific AI output quality.

13. DMCA & Copyright Claims

If you believe content generated on our platform infringes your copyright, you may submit a DMCA takedown notice to dmca@contentpole.com. Your notice must include identification of the copyrighted work, the allegedly infringing content, your contact information, and a statement of good faith belief. We will investigate all valid claims and remove infringing content in accordance with 17 U.S.C. § 512.

14. Export Controls

Our AI services may be subject to U.S. export control laws and regulations. You agree not to access or use the service from any country, territory, or jurisdiction subject to U.S. embargoes or trade sanctions, and you represent that you are not on any U.S. government restricted party list.

15. Dispute Resolution

Any disputes arising from these terms shall be resolved through binding arbitration in accordance with applicable laws. Before initiating arbitration, you agree to attempt to resolve disputes informally by contacting us at support@contentpole.com. These terms are governed by the laws of the State of Delaware, United States.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Contentpole regarding the use of our service, and supersede all prior or contemporaneous communications and proposals.

18. Changes to Terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify you of material changes via email or through the platform.
